These Terms & Conditions (“Terms”) govern the use of the Obsidio platform, operated by Papers AG, Baarerstrasse 43, 6300 Zug, Switzerland (“Papers AG”, “we”, “us”). Obsidio is a product of Papers AG. By accessing or using Obsidio, you (“Customer”) agree to be bound by these Terms.
1. Scope of Application
These Terms apply to all use of the Obsidio platform (www.obsidio.com and app.obsidio.com as well as obsidio.io and obsidio.app and obsidio.ch with all related subdomains) and related services provided by Papers AG.
Separate enterprise agreements may apply where specifically signed.
2. Services Provided
Obsidio provides a software-as-a-service (SaaS) platform for resilience simulations, reporting, and related functionalities.
Consulting services may be provided by agreement but are not included by default.
The platform operates on a credit system, which determines the scope of simulations available.
3. Customer Eligibility & Accounts
Obsidio is offered exclusively to business clients (B2B). By registering, the Customer confirms they are acting on behalf of a business entity.
Customers are responsible for maintaining the confidentiality of their login credentials and for all activities under their account.
4. Authorized Use & Misuse Prevention
Customers may only use Obsidio to test systems they own or are explicitly authorized to test. Verification may be required (e.g., DNS TXT entry).
Use of the platform for unauthorized or illegal activities is strictly prohibited.
Papers AG reserves the right to suspend or terminate access immediately in case of misuse or suspicion of unauthorized activity.
5. Credits, Pricing & Payment
Use of the platform is based on credits, available for purchase via the platform or through enterprise agreements (monthly or yearly).
Credits are non-transferable and non-refundable unless otherwise agreed.
All prices are exclusive of VAT unless otherwise stated.
Invoices must be paid within the period stated. Late payments may result in suspension of access.
6. Intellectual Property
All rights to the Obsidio platform, software, logos, reports, and documentation remain with Papers AG.
Customers receive a non-exclusive, non-transferable right of use for the duration of their contract.
Customers may not copy, reverse-engineer, or modify the software.
7. Data Protection & Security
Data processing is governed by our Privacy Policy.
While Obsidio uses technical measures (e.g., Trusted Execution Environments, encryption), Customers remain responsible for their own infrastructure security.
8. Liability & Warranty
Obsidio is provided “as is” without any warranty or guarantee.
Papers AG disclaims all liability for damages arising from use of the platform, including but not limited to interruptions, downtime, simulation effects, data loss, or indirect damages.
Liability is limited to cases of intent or gross negligence under Swiss law.
9. No Service Level Guarantees
Papers AG does not provide uptime, performance, or service guarantees unless separately agreed in a signed enterprise contract.
10. Term & Termination
Access continues for as long as credits are available or until terminated by either party.
Papers AG may terminate access immediately in case of misuse, non-payment, or breach of Terms.
Enterprise agreements may include different notice periods as agreed in writing.
11. Amendments
Papers AG may amend these Terms at any time. The updated Terms will be published on the website. Continued use of the platform constitutes acceptance.
12. Governing Law & Jurisdiction
These Terms are governed by Swiss law. The exclusive place of jurisdiction is Zug, Switzerland.
Disclaimer
Obsidio is a product of Papers AG, Zug, Switzerland.
Resilience simulations are executed only with explicit Customer authorization. Papers AG accepts no liability for misuse of the platform or for consequences of simulations carried out on authorized systems.
